Cannabis and Animal Food: Regulatory Frameworks, Uncertainties, and Strategies for Industry

Sales of CBD-containing pet products have more than doubled in the United States in the last few years, and demand for hemp-based products, including CBD, in the pet product market continues to grow. While the 2018 Farm Bill removed hemp from regulation as a controlled substance, this does not necessarily give the green light to hemp-containing pet foods. Currently, the FDA has not approved CBD for any use in animals, and the Federal Trade Commission has raised questions about the safety and effectiveness of CBD in pet foods. Notably, however, the regulation of CBD in pet foods varies at the state level – some states are more lenient than others on the use of hemp in pet foods. This webinar will discuss the federal regulation of CBD-containing pet foods; explore questions raised by regulators regarding the safety and efficacy of CBD in pet foods; analyze the various regulatory approaches taken at the state level regarding these products; and evaluate the enforcement risks associated with marketing and distributing such products.
